The Bombay High Court has put up an extremely sensitive question to state government asking about its stand on whether parents be allowed to conduct DNA test on their child to confirm paternity.
The Court raised the question while hearing a petition filed by couple demanding a DNA test to determine the paternity of their child who was born through surrogacy at a city hospital on Oct. 15, 2019. The couple believes the hospital has mislead them in the surrogacy procedure and are passing off someone else’s child as theirs.
A division bench of Justice B. P. Dharmadhikari and N. R. Borkar wanted to know whether anyone can just walk into a forensic laboratory, and get a DNA test done by paying the requisite fees? The couple have filed the petition against the hospital and its doctors since they doubted whether the baby, which the hospital claimed was theirs, was really theirs? They wan an FIR to be filed against the concerned doctors and the hospital if it was proved that the child did not share the couple’s DNA.
