The Delhi Medical Council was in for a shock when the Delhi High Court cancelled the clean chit given by them to the doctors of Fortis Hospital in medical negligence case.
The doctors were sued by parents of a two year old toddler who was rendered mentally and physically disabled due to brain haemorrhage suffered during delivery. Justice Navin Chawla, issued a notice to Delhi Medical Council (DMC), Medical Council of India (MCI) and Fortis Hospital seeking their stand on a plea moved on behalf of the infant and his mother, challenging the clean chit.
The petition claims that DMC presided over the matter as an expert body despite not having the authority and converted into disciplinary proceedings in which it held that there was no medical negligence on part of the doctors.
The petition further claimed that the hospital had tried to conceal the brain haemorrhage suffered by the new born during caesarean delivery and the therefore the infant was deprived of timely treatment due to which the injury got aggravated to an irreversible extent.
